To: The Under 17 Car Club Charitable Trust hereinafter referred to as ‘The Club’ (which expression includes The Under 17 Car Club Limited, U17 Drivers Pathfinder Limited and all Subsidiary and Associated Companies).
We the above named and undersigned hereby apply to be admitted as Members (whether Driving, Pathfinder, Associate, Supporter, Instructor or Marshal) of The Club or for admission as a guest to any event organised by the Club as a Contractor, Sub-Contractor or other Third Party.
We have read the Pathfinder Terms and Conditions and hereby agree to be bound by and observe them and any alterations or additions thereto which may from time to time be made.
In consideration of our being admitted as Pathfinder Members or as a guest of The Club we hereby undertake and agree that in consideration of any or all of us being carried separately or together in a vehicle driven by any Member, Official or Guest of The Club or with the permission of The Club driving a vehicle at any event or meeting of The Club whether or not accompanied in the vehicle by an adult or adults, or Member or Members, neither we nor our personal representatives will make any claim against The Club, its Officers or Servants, or against the owners, leaseholders, tenants or licencees of any land or premises upon which any event or meeting of The Club is held, in respect of any loss of or damage to property or injury to person (including injury resulting in death) which we may suffer whilst or in consequence of being so carried or so driving or being present at an event or meeting of The Club and we understand that no compensation will be paid by The Club, its Officers or Servants in respect of such loss or injury and we and our personal representatives, so as to bind ourselves jointly and severally in perpetuity, hereby indemnify The Club, its Officers or Servants or Agents against any claim which may be made by any third party against us arising out of any act, omission, neglect or default whatsoever on our part during or in connection with the said carriage, driving or attendance at any event or meeting of The Club or associated with Members of The Club.
We understand that the Club provides NO insurance cover for any vehicle when participating in Club activities and that we are responsible for arranging cover to meet our own specific requirements should we feel insurance is necessary for driving activities on private land.
This application is governed by and construed in accordance with English law and each party irrevocably submits to the exclusive jurisdiction of the Courts of England.
